NIE Number & Certificate of Residence: What’s the Difference?

At Atlandix, we often receive questions about two commonly confused terms, especially among foreigners who wish to buy property or settle in Spain: the NIE number and the Certificate of Residence.

What exactly is the NIE? Is it the same as a residence number? Which one proves that you legally reside in Spain? Let’s clarify the confusion.

1. Key differences between the NIE and the Certificate of Residence

Although many people believe they are the same, the NIE (Foreigner Identification Number) and the Certificate of Residence serve very different purposes.

The NIE is a tax identification number issued to foreigners by Spanish authorities. It does not grant you the right to reside in Spain. However, it is essential for legal and financial transactions such as buying property, opening a bank account, or paying taxes.

The Certificate of Residence, on the other hand, is the document that proves you legally live in Spain. It is mandatory for all foreigners who establish habitual residence and is issued by the local police offices.

  • EU citizens can easily apply for it once in Spain.
  • Non-EU nationals must follow a more complex process, usually starting at the Spanish consulate in their home country.

2. What is the NIE?

The NIE (Número de Identificación de Extranjero) is a unique, personal number assigned to foreigners who have legal, economic, or social ties to Spain. This number is required for nearly every formal process in Spain: from buying real estate to setting up utility contracts.

The NIE does not expire, but it does not grant legal residence.

3. Do you need a lawyer to get the NIE?

While it’s not legally required, working with a legal professional can make the process much smoother. At Atlandix Legal, we guide our clients through every step—from preparing documents to submitting the application correctly.

A solicitor understands which forms to complete, what fees to pay, and where to submit everything. We can also act as your legal representative in Spain, helping you get your NIE even if you’re abroad.
